fa اصول جرم‌انگاری و چالش‌های آن در نظام جزایی افغانستان تخصصي Special پژوهشي Research <div style="text-align: justify;">جرم‌انگاری از ستون‌های اصلی نظام جزایی هر کشور است که هدفش مشخص کردن مرز رفتارهای قابل‌قبول و غیرقابل‌قبول در جامعه و تضمین امنیت و عدالت اجتماعی است. در این مقاله، اصول مهم جرم‌انگاری مثل اصل هنجاری بودن، ضرورت، تناسب، رعایت حقوق فردی، کارایی، اخلاقی بودن و عدم تبعیض مطالعه و بررسی و همچنین، محدودیت‌ها و چالش‌های اجرای این اصول در افغانستان با روش تحلیلی توصیفی ارزیابی شده است. هدف از تحقیق تبیین چالش اصول جرم انگاری و ارائه راهکار است. یافته‌ها نشان می‌دهد که قوانین پراکنده، اجرای سلیقه‌ای، و کمبود رعایت حقوق فردی از مهم‌ترین موانع اجرای صحیح این اصول هستند. پیشنهاد می‌شود که با بازنگری قوانین و تطبیق با استانداردهای بین‌المللی، عدالت جزایی در افغانستان تقویت شود.</div> <div style="text-align: justify;">Criminalization constitutes one of the fundamental pillars of the criminal justice system of every state, serving to delineate the boundaries between acceptable and unacceptable conduct within society and to ensure social security and justice. This article examines key principles of criminalization&mdash;such as normativity, necessity, proportionality, respect for individual rights, effectiveness, morality, and non-discrimination&mdash;and evaluates the limitations and challenges associated with their implementation in Afghanistan through a descriptive&ndash;analytical method. The purpose of this study is to elucidate the challenges surrounding the principles of criminalization and to propose appropriate solutions.<br> The findings indicate that fragmented legislation, discretionary and inconsistent enforcement, and insufficient protection of individual rights constitute major obstacles to the proper application of these principles.
