fa مطالعه‌ی تطبیقی اصل اجرای کامل تعهد قراردادی در فقه امامیه و اصول یونیدروا تخصصي Special پژوهشي Research <div style="text-align: justify;">اصل اجرای کاملِ تعهدِ قراردادی (انجامِ موردِ تعهد بدون کاستی در کمیت و کیفیت)، هدف واقعی و روح معاملات معاوضی &nbsp;است. فقه امامیه و اصول یونیدروا بر این اصل تأکید کرده‌اند. مطالعه‌ی کتاب‌خانه‌ای و روشِ توصیفی- تحلیلی نشان می‌دهد که فقه امامیه از مزیتِ &laquo;بیانِ ساختار مفهوم‌یابی اصل اجرای کامل تعهد&raquo;، &laquo;تعیین معیارهای گوناگون برای ایفای تعهد با تکیه به گوناگونی موردهای تعهد&raquo; و &laquo;تکلیفِ متعهدله به پذیرش اجرای کامل تعهد&raquo; بهره‌مند است. اصول قراردادهای تجاری بین‌المللی بر &laquo;تأثیر نوسات ارزش پول در اجرای تعهدات پولی&raquo;، &laquo;معیار کیفیت متعارف اجرا&raquo;، &laquo;اصل حسن‌نیت در ایفای تعهد&raquo; و &nbsp;&laquo;همکاری متعهدله در اجرای کامل تعهد&raquo; توجه داده است. همین توجه‌ها، مسیرِ تأمل‌های نوین را برای استنباط‌های تازه‌ی فقیهانِ امامیه در زمینه‌ی وفایِ عهد می‌گشاید.</div> <div style="text-align: justify;"><span style="font-size:14pt"><span style="unicode-bidi:embed"><span style="font-family:IRLotus"><span style="font-weight:bold"><span style="font-size:12.0pt"><span new="" roman="" style="font-family:" times=""><span style="font-weight:normal">The principle of full implementation of the contractual obligation (fulfillment of the obligation without deficiency in quantity and quality) is the real goal and spirit of barter transactions. Imamiyyah jurisprudence and principles of Unidrava have emphasized this principle. A library study and a descriptive-analytical method show that Imami jurisprudence has the advantage of &quot;expressing the conceptualization structure of the principle of full implementation of the obligation&quot;, &quot;determining various criteria for fulfilling the obligation based on the variety of the obligations&quot; and &quot;the obligee&#39;s duty to accept the full implementation of the obligation.</span></span></span></span></span></span></span><br> <span style="font-size:14pt"><span style="unicode-bidi:embed"><span style="font-family:IRLotus"><span style="font-weight:bold"><span style="font-size:12.0pt"><span new="" roman="" style="font-family:" times=""><span style="font-weight:normal">The principles of international commercial contracts have paid attention to &quot;the effect of fluctuations in the value of money in the implementation of monetary obligations&quot;, &quot;the conventional quality standard of implementation&quot;, &quot;the principle of good faith in the fulfillment of the obligation&quot; and &quot;the cooperation of the obligor in the full implementation of the obligation&quot;.
