fa مشروعیت حکومت دینی در فقه سیاسی با تأکید بر دیدگاه آیت الله محسنی (ره) عمومى General پژوهشي Research <div style="text-align: justify;">مشروعیت نظام‌های سیاسی تحت عنوان &laquo;مشروعیت سیاسی&raquo; برای توضیح حق حاکمیت یک نظام حکومتی، مورد بحث قرار می‌گیرد. موضوع مبانی مشروعیت حکومت‌‌‌، یکی از مباحث مهم در حوزه فقه سیاسی و فلسفه سیاسی می&not;باشد که در علوم و جامعه شناسی سیاسی بصورت مفصل به آن پرداخته شده است. حکومت دینی نیز برای اقناع مردم و جامعه ضرورت به توجیه حق حاکمیت دارند تا بتوانند به اعمال قدرت شان مشروعیت ببخشند &nbsp;و توضیح دهند که بر اساس کدام مبنا، حق حاکمیت بر مردم را دارند. در اندیشه سیاسی غرب دو عنصر مقبولیت و قانونیت به عنوان عناصر اصلی مشروعیت نظام سیاسی یاد شده است. در فقه سیاسی اسلام در باب مشروعیت نظام دینی، ضمن توافق نظر در باره امهات اصول دینی، در مبانی مشروعیت تفاوت نظر وجود دارد که در دو دیدگاه فقهای اهل سنت و فقهای اهل شیعه قابل دسته‌بندی شده است.&nbsp;<br> آیت الله محسنی(ره) در فقه سیاسی، مباحث راجع به مشروعیت حکومت دینی، بر مبنای بحث های فلسفی و کلامی مورد توجه قرار گرفته است. ایشان در آثار متعدد، مباحثی مرتبط با مشروعیت حکومت دینی را مطرح نموده است و به دو مبنای مشروعیت الاهی و مشروعیت مردمی اشاره کرده است. ایشان ضمن اشاره بر واگذاری تعیین شکل و چگونگی حکومت به مردم در آموزه های دینی، مبانی مشروعیت الهی را تحت عناوین منابع تقنین، اوصاف زمامداران، تطبیق عدالت اجتماعی و مسؤلیت های اصلی حکومت دینی بحث نموده است.</div> <div style="text-align: justify;">The legitimacy of political systems is discussed under the title of &quot;political legitimacy&quot; to explain the right of sovereignty of a government system. In order to convince the people and the society, the religious government needs to justify the right of sovereignty so that they can give legitimacy to the exercise of their power and explain on which basis they have the right to rule over the people. In Western political thought, two elements of acceptability and legality are mentioned as the main elements of the legitimacy of the political system. In the political jurisprudence of Islam regarding the legitimacy of the religious system, while agreeing on the principles of religious principles, there is a difference of opinion on the basis of legitimacy, which can be categorized into two views of Sunni and Shiite jurists.<br> In political jurisprudence of Ayatollah Mohseni (RA), discussions about the legitimacy of the religious government have been considered based on philosophical and theological discussions. In numerous works, he has raised issues related to the legitimacy of the religious government and has pointed to the two bases of divine legitimacy and popular legitimacy.
