fa جرائم نقض مقررات هوانوردی ملکی، در قوانین جزای افغانستان عمومى General پژوهشي Research <div style="text-align: justify;">طیاره و پرواز با آن، ضمن اینکه رفاه و آسایش را در مسافرت‌ها به ارمغان آورده، همواره با اضطراب و تشویش همراه بوده است. در میان انواع طیاره‌ها، طیارۀ ملکی، به‌عنوان وسیله‌ای که مهم‌ترین ویژگی آن سرعت است، جایگاه منحصربه‌فردی در حمل‌ونقل کالا و مسافر به دست آورده و توانسته است صنعت هوا نوردی را، به‌عنوان یکی از محورهای اصلی توسعه اقتصادی در جهان، مورد توجه قرار دهد. دغدغۀ کشورها و مجامع بین‌المللی درخصوص تأمین و حفظ امنیت پرواز طیاره و مصونیت آن در قالب تصویب قوانین و مقررات داخلی و کنوانسیون‌های بین‌المللی تبارز یافته است. در عرصۀ حقوق داخلی افغانستان، قوانین متعددی. مانند مقررۀ ادارۀ عمومی هوانوردی ملکی (1363)، مقررۀ تنظیم وظایف و اجراییات وزارت هوانوردی ملکی (1367) و قانون هوانوردی ملکی در جهت نظم و نسق ترانسپورت هوایی (1391) برای تنظیم و حفظ امنیت سیستم هوانوردی به تصویب رسیده‌اند. قوانین ذکرشده، تدابیر و مقررات قابل توجه مدیریت و ایمنی پرواز طیارۀ ملکی را پیش‌بینی نموده است، اما ضمانت اجرای این مقررات را به قانون خاصی (قانون جزا) ارجاع داده است. برخی از مقررات مربوط به ایمنی پرواز، حمل‌ونقل هوایی، رعایت قلمروی هوایی و جلوگیری از تخلفات پرواز و نقض قواعد حاکم بر ترانسپورت هوایی به‌صورت پراکنده در قانون جزایی (1355) پیش‌بینی شده بودند، اما قانون‌گذار افغانستان، به‌صورت ویژه در کود جزا، درخصوص حفظ امنیت هوانوردی همگام با اسناد بین‌المللی، فصل مستقلی را تحت‌عنوان جرائم نقض هوانوردی ملکی اختصاص داده و مجازات اشخاص حقیقی و حکمی نقض‌کنندۀ قوانین هوانوردی ملکی را تعیین و تصویب نموده است.</div> <div style="text-align: justify;">The plane and the flight with it, while bringing prosperity and comfort in travel, have always been associated with anxiety and worry. Among the types of aircraft, the civil aircraft, as a vehicle whose most important feature is speed, has gained a unique position in the transportation of goods and passengers and has been able to attract the attention of the aviation industry as one of the main axes of economic development in the world. The concern of countries and international organizations regarding the provision and maintenance of aircraft flight safety and its immunity has been expressed in the form of approving domestic laws and regulations and international conventions. In the field of internal law in Afghanistan, there are many laws. Such as the regulation of the General Administration of Civil Aviation (1363), the regulation of the duties and implementation of the Ministry of Civil Aviation (1367), and the law of civil aviation to regulate air transportation (1391) have been approved to regulate and maintain the security of the aviation system. The mentioned laws have provided significant measures and regulations for the management and safety of civil aircraft flights, but the guarantee of the implementation of these regulations has been referred to as a special law (penal law).
