fa عوامل مؤثر بر اجرای حقوق بشر در افغانستان عمومى General پژوهشي Research <div style="text-align: justify;">حقوق بشر، بدون توجه به نگاهی خاص، به امتیازات و حقوقی اطلاق می‌شود که انسان‌ها به‌صِرف انسان بودن از آن برخوردار هستند. امروزه، جوامع بشری و نظام بین‌الملل پس از گذار از مرحلۀ تاریک و سیاهی- که انسان‌ها در آن از حیثیت انسانی خود به‌طور سزاوار برخوردار نبودند و از یک‌سو مدام مورد بی‌مهری‌های هم‌نوعان خود و ازسوی‌دیگر مورد ظلم و بی‌رحمی‌های حاکمان قرار می‌گرفتند- از این ارزش‌ها به‌عنوان جزء لاینفک زندگی انسانی استقبال نموده و آن‌ها را به‌عنوان یکی از اصول و ارزش‌های بنیادین بین‌المللی به رسمیت شناخته‌اند. این تحقیق، عوامل مؤثر بر اجرای حقوق بشر در جامعۀ اسلامی افغانستان را با روش توصیفی-تحلیلی بررسی کرده و زمینه‌های اجرایی شدن آن را با توجه به ساختار و بافت اجتماعی و فرهنگی افغانستان واکاوی نموده است. با توجه به اینکه افغانستان از نظر اجتماعی، جامعه‌ای سنتی و از نظر فرهنگی، مردم آن پایبندی عمیق به ارزش‌های دینی و اسلامی دارند، بررسی عوامل مؤثر بر اجرا و رعایت حقوق بشر در این سرزمین با رویکرد جامعه‌شناسی حقوقی دقیق‌تر می‌نماید. نویسنده با مراجعه به منابع کتابخانه‌ای و الکترونیک و با درنظرداشت سنت و فرهنگ حاکم بر این سرزمین، در نخست به بررسی و اثبات امکان اجرای حقوق بشر با بینش اسلامی در جامعۀ اسلامی افغانستان پرداخته است. سپس مواردی چون شناخت تضمین‌های حقوق بشری، حاکمیت قانون (شریعت)، کارآمدی حکومت، رشد و توسعۀ خرد جمعی و فناوری‌های ارتباطی را به‌عنوان عوامل مهم و تأثیرگذار بر اجرایی شدن حقوق بشر در افغانستان به شمار آورده است.</div> <div style="text-align: justify;">Human rights, regardless of a particular point of view, refer to privileges and rights that humans have for simply being human. Today, human societies and the international system, after the transition from the dark and black stage - in which people did not enjoy their human dignity as they deserved and were constantly subjected to the unkindness of their fellows on the one hand and the cruelty of the rulers on the other hand - these values as They have welcomed an integral part of human life and recognized them as one of the international fundamental principles and values. This research has investigated the factors affecting the implementation of human rights in the Islamic society of Afghanistan with a descriptive-analytical method and analyzed the fields of its implementation according to the social and cultural structure and context of Afghanistan. Considering that Afghanistan is a traditional society socially and culturally, and its people have a deep adherence to religious and Islamic values, it is more accurate to investigate the factors affecting the implementation and observance of human rights in this land with the approach of legal sociology. By referring to library and electronic resources and keeping in mind the tradition and culture ruling this land, the author has first examined and proved the possibility of implementing human rights with an Islamic vision in the Islamic society of Afghanistan.
