fa راهکارهای حقوقی استقرار صلح پایدار در افغانستان (سیاست‌های حقوقی دولت و صلح پایدار) تخصصي Special پژوهشي Research <div style="text-align: justify;">صلح پایدار و تضمین آن، که حق مسلم شهروندان است، در افغانستان با چالش‌هایی روبروست. برای رفع این چالش‌ها به راهکارهای حقوقی نیاز داریم که باید در قالب سیاست درآیند و با استفادۀ آن‌ها مردم این سرزمین شاهد زندگی مسالمت‌آمیز و صلح پایدار باشند. بدین رو، صلح پایدار، حق (ادعای) مسلم تلقی می‌شود و برای تضمین آن راهکارهای حقوقی و سیاست‌های دولت با استفاده از روش کتابخانه‌ای و میدانی، رویکرد حقوقی، فلسفۀ حقوق و جامعه‌شناسی و سازوکار توصیفی، تحلیلی، استقرائی و برهانی تجزیه‌وتحلیل و ارزیابی شده‌اند. راهکارهای حقوقی و سیاست‌های کلیدی درراستای تضمین صلح پایدار در افغانستان، احترام و تضمین کرامت انسانی، امنیت انسانی، برابری فرصت و آمایش سرزمینی عادلانه تلقی می‌شوند که دولت باید آن را در صدر سیاست‌های کلان خود قرار دهد. در عین حال، حکومت باید بیش از پیش بر کرامت انسانی- که مبنای امنیت انسانی است- برابری فرصت و آمایش سرزمینی عادلانه- که شاه‌کلید تأمین صلح پایدار است- تمرکز کند و آن را محور استراتژی، سیاست و برنامه-های کلان خود قرار دهد. در این تحقیق، بیشتر اثبات رابطۀ پدیداری میان مسائل یادشده و تضمین صلح پایدار مورد توجه قرار گرفته است.</div> <div style="text-align: justify;">Sustainable peace and its guarantee are the indisputable rights of citizens who are facing challenges in Afghanistan, and to overcome these challenges, legal solutions are needed that must be put into the form of policies with their implementation, so the people of this land will witness a peaceful life and sustainable peace. Therefore, in this research, sustainable peace is considered a right-claim, and to guarantee it, legal solutions and government policies have been analyzed and evaluated with a legal approach, philosophy of law, and sociology using library and field methods, as well as descriptive, analytical, inductive, and deductive research methods. The key legal solutions and policies to ensure sustainable peace in Afghanistan are respect and guarantee of human dignity, human security, equality of opportunity, and fair territorial planning, which the government should put at the top of its major policies. At the same time, the government should focus more on human dignity as the basis of human security, equality of opportunity, and fair territorial planning as the key to ensuring sustainable peace and place it as the axis of its strategy, policy, and major programs.
