fa وظایف و صلاحیت‌های سارنوال محکمه جزای بین‌الملل تخصصي Special پژوهشي Research <div style="text-align: justify;">از رکن&not;های مهم دیوان جزای بین‌المللی، سارنوالی است. ادارۀ امور سارنوالی به‌عهده سارنوال است. سارنوالی دارای معاونان و مشاورانی با تخصص حقوقی مربوط به مسائل مختلف به‌ویژه تجاوز جنسی، خشونت مبتنی‌بر جنسیت و تجاوز به اطفال است. سارنوال هم در مرحله تحقیق و تعقیب و هم در مرحله محاکمه دارای وظایف و صلاحیت‌های مهم است که دسترسی دیوان جزای بین‌الملل را به اهداف موردنظر تأمین و تسهیل می‌نماید. سؤال این است که سارنوال در کدام وضعیت می‌تواند متهمان به جرایم بین‌المللی را تحت تحقیق و تعقیب قرار داده و وظایف و صلاحیت‌های خود را اعمال نماید؟ مقاله حاضر تلاش برای پاسخ‌یابی به این سؤال است و با استفاده از روش توصیفی-تحلیلی به بررسی آن می‌پردازد. از بررسی اساسنامه رم و اسناد مرتبط با دیوان جزای بین‌الملل، به دست می‌آید که با ارجاع وضعیت یک یا چند تا از جنایات بین‌المللی از سوی دولت‌های عضو یا شورای امنیت سازمان ملل متحد به خارنوال محکمه جزای بین‌الملل یا با توجه به اطلاعات واصله به خارنوال در مورد فجیع‌ترین جنایات بین‌المللی، وی می‌تواند به جمع‌آوری اطلاعات از منابع معتبر در مورد پرداخته و تحقیقات لازم را انجام دهد و درصورتی‌که به دلایل معقول و معتبر در زمینه دسترسی پیدا نماید، از شعبه مقدماتی دیوان جزای بین‌الملل تقاضای مجوز تحقیقات رسمی را داشته و با تأیید شعبه مقدماتی صلاحیت‌های خود را در مرحله قبل از محاکمه و بعد از آن اعمال نماید.&nbsp;</div> <div style="text-align: justify;">One of the important elements of the International Criminal Court is the prosecutor. The prosecutor is responsible for managing the prosecutor&#39;s affairs. The prosecutor has deputies and advisors with legal expertise related to various issues, especially sexual assault, gender-based violence, and child abuse. The prosecutor has important duties and powers at the investigation and prosecution stages and the trial stage that ensure and facilitate the International Criminal Court&#39;s access to its intended goals. The question is, in which situation can the prosecutor investigate and prosecute those accused of international crimes and exercise his duties and powers? The present article attempts to answer this question and examines it using a descriptive-analytical method.
