fa کرامت انسانی و حق بر صلح پایدار تخصصي Special پژوهشي Research <div style="text-align: justify;">حق بر صلح پایدار از مصادیق نسل سوم حقوق بشر مبانی‌ای دارد که از جمله آنها کرامت ذاتی انسان است که این مبنا کارکردهای معین دارد و این کارکردها به روش استقرایی و قیاسی در این نوشتار با هدف تحلیل و تبیین کارکردها و فواید آنها مورد توجه قرار گرفته است. طبعاً در هر جامعه&not;ای که کرامت انسانی رعایت شود، حق بر صلح پایدار را موجه و مشروع و درعین‌حال قلمرو و دامنه آن را نیز مشخص می&not;کند. در صورت ناسازگاری صلح منفی با عدالت، برابری فرصت، نسل اول و دوم حقوق انسان‌ها، صلح منفی مقدم نخواهد بود؛ زیرا در فرض برقراری صلح منفی به بهای نقض موارد یادشده، کرامت انسانی خدشه&not;دار خواهد شد. همین‌طور شکنجه به‌منظور تضمین صلح منفی موجه و مشروع نخواهد بود؛ چون شکنجه خلاف کرامت انسانی است. وانگهی تضمین امنیت سنتی نمی&not;تواند ناقض حق بر صلح پایدار باشد. درنهایت صلح پایدار به تحقق عدالت و برابری فرصت منوط است؛ زیرا کرامت انسانی تضمین&not;کننده همگی است.&nbsp;</div> <div style="text-align: justify;">The right to sustainable peace is an example of the third generation of human rights and has foundations, including the inherent dignity of man, which has certain functions, and these functions have been considered in this article in an inductive and deductive manner with the aim of analyzing and explaining their functions and benefits. Naturally, in any society where human dignity is respected, the right to sustainable peace is justified and legitimate, and at the same time, it also determines its scope and scope. In the event of incompatibility of negative peace with justice, equality of opportunity, and the first and second generations of human rights, negative peace will not prevail. Because if negative peace is established at the cost of violating the aforementioned issues, human dignity will be violated. Similarly, torture will not be justified and legitimate in order to guarantee negative peace, because torture is against human dignity. Moreover, ensuring traditional security cannot violate the right to sustainable peace.
